Mine safety cost recovery regulation

NSW Resources invites comment on the proposed Mine and Petroleum Site Safety (Cost Recovery) Regulation 2025 (PDF, 187.09 KB).

The proposed Regulation will remake the Mine and Petroleum Site Safety (Cost Recovery) Regulation 2019, which is due to be automatically repealed on 1 September 2025, with minor changes.

The proposed Regulation supports the Mine and Petroleum Site Safety (Cost Recovery) Act 2005 (the Act), which provides for the funding of regulatory activities in relation to safety at mines and petroleum sites in NSW. The Act establishes the Mine and Petroleum Site Safety Fund (the Fund) for this purpose.

The Proposed Regulation

It is proposed that the Regulation be remade on substantially the same terms as the Regulation currently in force, and that the following substantive provisions be retained:

  • To authorise payments from the Fund of amounts required to meet expenditure incurred by the Department of Primary Industries and Regional Development in:
    • carrying out regulatory activities under, or administering or executing, the Explosives Act 2003; and
    • exercising functions under or in connection with the Protection from Harmful Radiation Act 1990;
  • To authorise members of staff of the State Insurance Regulatory Authority as a class of persons to whom the Secretary may delegate their functions; and
  • To require the Secretary of the Department to prepare a report containing an overview of payments made from the Fund during the financial year.

Minor amendments are proposed to:

  • replace the term ‘relevant period’ with ‘financial year’ in connection with reporting requirements and to align with the definition of ‘financial year’ in the Act;
  • update titles of legislation; and
  • update wording to reflect current regulatory drafting conventions.

An Explanatory Guide (PDF, 77.93 KB) is available which provides interested members of the public with an overview of the proposed Regulation and the intended changes.
